APLIFY — TERMS OF USE

1. Introduction

By accessing or using Aplify (via mobile app or website), you agree to be bound by these Terms of Use (\"Terms\") along with our Privacy Policy. If you do not agree with these Terms, please refrain from using the Platform.

2. Acceptance of Terms

By registering, logging in, or accessing Aplify, you confirm that:

• You are at least 18 years of age and legally competent to enter into binding contracts;
• You understand and agree that Aplify acts solely as a facilitator for user-to-user (C2C) interactions;
• You consent to Aplify’s Privacy Policy and its data handling practices; and
• You agree that Aplify may contact you via SMS, email, or app notifications for verification, service updates, and promotional communication (with opt-out available). Contact support

3. Eligibility

Aplify is available for use by:

• Indian residents aged 18 years or older;
• Individuals or entities legally authorized to transact under Indian law.

Users registering as "Armed Forces" confirm that they are serving, retired, or family members of personnel belonging to the Indian Armed Forces. Users registering as "Others" represent the general public.

4. User Account and Registration

To access or post on Aplify, you must create an account by providing your name, email, phone number, and community selection (Armed Forces or Others). Social login (Google) may also be used.

You may modify your name and community selection at any time before completing KYC verification. After verification these details cannot be changed.

You are responsible for maintaining confidentiality of your credentials and all activities under your account. Immediately notify Aplify at info@aplify.in of any unauthorized use.

5. User Responsibilities and Conduct

By using Aplify, you agree to:

• Post accurate, lawful, and non-misleading information;
• Comply with applicable laws, community rules, and these Terms;
• Exercise caution and independently verify other users before transacting;
• Avoid uploading or transmitting harmful, defamatory, or fraudulent material;
• Refrain from scraping, data mining, or spamming activities. Report abuse

6. Listing and Posting Rules

Users may create and post listings across multiple categories offered on the Platform, including but not limited to Mobiles, Cars, Bikes, Electronics, Furniture, Self-Drive, Rentals, Real Estate, Jobs, Hotels, Costumes, Packing Materials, Fitness & Sports, Leisure, and Services.

By posting a listing, you confirm that:

• The content is accurate and belongs to you;
• You have lawful ownership or rights to post;
• Information such as property address, business details, or job data is provided voluntarily at your own discretion;
• You assume full responsibility for its accuracy.

7. Community Guidelines (Armed Forces & Others)

Aplify features two communities — Armed Forces (serving, retired, and their families) and Others — to facilitate intra- and inter-community connections. Filters are provided only for convenience.

KYC Verification

Aplify provides an optional verification process to reduce spam or impersonation. Accepted documents examples are listed for both communities.

8. Prohibited Content and Activities

Users must not post or engage in activities that include:

• False, deceptive, or misleading content;
• Pornographic, obscene, or defamatory materials;
• Content violating third-party intellectual property;
• Sale or promotion of prohibited items (arms, narcotics, counterfeit goods, etc.);
• Discrimination or hate speech;
• Attempt to hack, scrape, or interfere with Platform operations.

9. User-Generated Content and Ownership

All listings, photos, text, and materials submitted by users remain their property. By posting on Aplify, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and promote your listing for platform operation, marketing, and analytics purposes.

10. License and Platform Use

Aplify grants users a limited, revocable, non-transferable, non-exclusive license to access and use the Platform in accordance with these Terms.

11. Paid Services and Promotions (Future Provision)

Aplify currently offers free access to users. However, in the future, certain premium listings, promotions, or advertising features may be chargeable. Details will be posted here when available.

12. Third-Party Links and Services

Aplify may contain links to third-party websites, apps, or advertisements. We do not control or endorse such third parties and are not responsible for their practices.

13. Intellectual Property Rights

All intellectual property, including logos, trademarks, UI design, code, and content created by Aplify, belongs to Dawnlight Business Services Pvt. Ltd. Unauthorized reproduction, modification, or commercial use of Aplify’s IP is strictly prohibited.

14. Limitation of Liability

To the fullest extent permitted by law, Aplify shall not be liable for:

• Any direct or indirect damages arising from user interactions, fraud, or misuse;
• Losses from unauthorized access or interruption of service;
• Accuracy or reliability of user-generated content.

15. Disclaimer of Warranties

Aplify is provided on an \"as-is\" and \"as-available\" basis. We make no warranties regarding uninterrupted availability, data accuracy, or content reliability. Users rely on listings and communications at their own risk.

16. Termination or Suspension of Account

Aplify may suspend or terminate accounts that violate these Terms or applicable law. Users may delete their account voluntarily via app settings or by contacting info@aplify.in.

17. Indemnification

You agree to indemnify and hold Aplify, its directors, employees, and partners harmless from any claims, damages, or losses arising from your breach of these Terms, misuse of the Platform, or violation of another person's rights.

Complaints will be acknowledged within 7 days and resolved within 30 days, per the IT Rules, 2021.

19. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with Indian laws. All disputes shall be subject to the exclusive jurisdiction of competent courts in Vijayawada, Andhra Pradesh.

20. Changes to Terms

Aplify reserves the right to modify these Terms at any time. Material changes will be communicated via app, website, or email notification. Your continued use constitutes acceptance of revised Terms.
